Under the New Jersey Tort Claims Act there are many limitations applicable when an injured party wants to sue any municipality or government agency in a tort action. It is absolutely critical that a Notice of Claim be filed with the municipality within 90 days of the accident or incident or the injury party will forever be barred from suing. This is a prerequisite. A lawsuit cannot be filed until six months after the filing of the Notice of Claim which allows the municipality to investigate the claim.
If you are injured in an accident involving a municipality, you should immediately contact an experienced lawyer who is familiar with the Torts Claims Act. In New Jersey, there are many immunities that municipalities have to defend these cases. If you are hurt, don’t wait to hire an experienced lawyer.
